The Demise of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency sparked by the introduction of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been stabilised. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The chain of opposing developments captured the bleak nature of the outgoing year. By day, diplomatic battles are conducted: positive announcements are issued from different nations. Immense energy is devoted on containing specific proposals. By night, the Kremlin clearly shows the world that, for them, war remains the key method for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is equipped to monitor rocket firings from Russian territory, a capability enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been deployed to counter approaching cruise missiles flew past – modern combat jets provided to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems thundered: several firings deployed against a incoming threat. This was a sophisticated defense system at work, probably supplied through Western nations. Every launch shakes the surroundings, shaking the windows. The brief panic quickly transforms into grim resignation: possibly the incoming missile won't cause damage this time, protecting urban areas from devastation and further power outages.

Persistent Threats

Not long after, a heavy machine gun fired at a unmanned aircraft somewhere nearby, part of a rapid response unit – probably allied-provided weaponry. Unfortunately, the shots failed to hit the enemy aircraft – it continued its flight toward its destination.

Intermittently, this carried on until dawn. Kyiv faced the morning news: several casualties, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still maintained normal activities – experiencing conflict. But those full day encapsulated Ukraine's vital need on international aid – a reliance that regional partners are demonstrably unable to fill in the near term.

Failed Diplomacy

The 28-point plan from US administration provoked deep reactions, discussion and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new initiative from Washington adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This pattern will, certainly, persist.

Tactical Assessments

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration works based on a premise familiar among experienced diplomats: you cannot secure via talks what you have failed to defend militarily. The US administration assumes that it is unfeasible to pressure the Kremlin to relinquish the land that it presently holds in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, US leadership does little to discourage Russia, through words or deeds, from believing that the situation will not evolve additionally in its advantage in the coming year.

Conflicting Perspectives

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their reason to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains supremely confident in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but preventing a complete military breakdown until conditions improve in its advantage.

Present Conditions

Factually, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: political desires to mediate resolution and secure international recognition, and Ukrainian leadership's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unacceptable, so that their focus does not move to homefront challenges. And although their mission will now be much harder after latest incidents, it remains quite doubtful that this will change their overall approach.

These two forces are influencing discussions.

Assessment and Future

It took a just a single week to eliminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, resistance by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, current information leaks, all served their function.

While new proposals based on established approaches are imminent, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and reflect particular unwillingness to alter the situation, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the foreseeable future, primarily depend on continued Western support.
